Artist Registry Agreement

This Agreement is between you (the artist, “you”) and Decatur Arts Alliance (“DAA,” “we,” “us”), a nonprofit organization located at 113 Clairemont Avenue, Decatur, GA 30030. It covers your membership in the DAA Artist Registry (the “Registry”) and the profile you create there.

By creating an account and checking the box below, you confirm that you have read and agree to this Agreement.

1. Who can join

To create an Artist Registry account, you must:

  • Be at least 18 years old.
  • Be an artist, or an individual authorized to represent an artist, ensemble, studio, or arts organization.
  • Provide accurate information about yourself and your work.
  • Maintain one account per artist or entity. Duplicate accounts may be removed.

2. Membership and payment

Annual membership

A listing in the Registry requires a paid annual membership. The current fee is shown at checkout. Payments are processed by Stripe, and your card details are handled by Stripe rather than stored by DAA.

Automatic renewal

Your membership renews automatically each year using the payment method on file, unless you cancel first. You may cancel at any time through the billing area of your account. When you cancel, your membership stays active through the end of the period you have already paid for, and your listing remains visible until that period ends.

If a payment lapses

If your membership expires or a payment fails, your public listing is hidden from the Registry. Your profile and its content are preserved, and your listing returns once payment is current again. You will not need to be re-reviewed after a simple lapse.

Refunds

Membership fees are non-refundable, including if your listing is removed for a violation of this Agreement. If you believe there has been a billing error, contact us and we will review it.

3. Review and approval

Every profile is reviewed by DAA staff before it appears publicly. A listing goes live only when it has been approved by DAA and your membership is active.

We may approve, decline, or ask you to revise a profile at our discretion, and we may remove or hide a listing at any time. Payment alone does not guarantee that a listing will be published. If we decline your profile, we will tell you why and give you the chance to make changes.

4. Your content

You keep ownership

You keep all ownership and copyright in the text, images, audio, video, and other material you add to your profile (“Your Content”). Nothing here transfers ownership of your work to DAA.

Permission you give DAA

By adding Your Content to the Registry, you give DAA permission to display, reproduce, and share it for the purpose of operating and promoting the Registry and the Decatur arts community. This includes:

  • Showing your profile on the DAA website.
  • Featuring your profile or work in DAA newsletters, social media, and promotional material about the Registry.
  • Resizing, cropping, or reformatting images so they display properly on the site.

This permission is non-exclusive and royalty-free, so you remain free to use and license your work however you like. It lasts while your listing is in the Registry. If your listing is removed, we will stop using Your Content going forward, though copies may remain in previously published material such as already-sent newsletters or archived social posts.

What you promise about Your Content

You confirm that:

  • You created Your Content, or you have permission to use and share it.
  • It does not infringe anyone’s copyright, trademark, or other rights.
  • You have permission from any identifiable person shown in your images.
  • It is accurate and not misleading about you or your work.

What you may not post

Do not upload content that is:

  • Unlawful, harassing, hateful, or threatening.
  • Sexually explicit, or otherwise inappropriate for a general audience.
  • Someone else’s work presented as your own.
  • Advertising or spam unrelated to your artistic practice.
  • Malicious code, or links to harmful sites.

We may remove any content that violates these standards, and we may suspend or remove accounts for repeated or serious violations.

5. What is public and what is not

Your Registry profile is a public web page. Anything you enter into a public field can be seen and indexed by search engines. That includes your name or business name, tagline, biography, disciplines, city, images, and any links you add.

Some information stays private and is not shown on your public profile:

  • Your phone number, which is collected so DAA staff can reach you.
  • Your account email address.
  • Your street address and payment details.

Visitors can contact you through a form on your profile. That form sends a message to your email address without displaying it on the page. Once you reply, the other person will have your email address, so use your judgment about what you share.

Please share only what you are comfortable making public. You can edit or remove information in your profile at any time.

6. Your account

  • Keep your password private, and let us know if you think someone else has accessed your account.
  • You are responsible for activity that happens under your account.
  • Keep your contact information current so we can reach you about your listing or membership.

7. Ending your membership

You may cancel your membership or delete your account at any time from your account area. Deleting your account removes your public listing and the media you uploaded.

We may suspend or end your membership if you violate this Agreement, if we are unable to collect payment, or if we discontinue the Registry. If we discontinue the Registry entirely, we will give you reasonable notice.

8. Privacy

Information you provide is used to operate the Registry, review your listing, manage your membership, and contact you about it. We do not sell your personal information. Payment processing is handled by Stripe under its own terms and privacy policy. See the DAA Privacy Policy on our website for more.

9. Service provided “as is”

The Registry is provided on an “as is” and “as available” basis. We work to keep it running well, but we do not guarantee that it will be uninterrupted, error-free, or that it will produce any particular result, such as sales, bookings, commissions, or exposure.

DAA is not a party to any agreement you make with someone who finds you through the Registry, and is not responsible for those interactions. Please use normal caution when arranging work or meetings with people you meet through the site.

10. Limitation of liability

To the fullest extent allowed by law, DAA is not liable for indirect, incidental, or consequential damages arising from your use of the Registry, including lost profits or lost opportunities. Our total liability to you for any claim relating to the Registry is limited to the amount of membership fees you paid us in the twelve months before the claim.

11. Changes to this Agreement

We may update this Agreement as the Registry evolves. If we make a significant change, we will notify you by email or through the site. Continuing to use the Registry after a change means you accept the updated Agreement.

12. Governing law

This Agreement is governed by the laws of the State of Georgia, United States, without regard to its conflict of law rules. Before taking formal action, please contact us so we can try to resolve the matter directly.
